Warranty of DAIWA Germany GmbH
for DAIWA fishing reels and rods


Warranty terms

 

1. Warranty provider, coverage for material and manufacturing defects.

DAIWA Germany GmbH, Georg-Brauchle-Ring 23-25, 80992 Munich, (hereinafter referred to as "DAIWA Germany"), provides a warranty against material and manufacturing defects for any fishing reel or rod (hereinafter referred to as "DAIWA Product") purchased from an authorized DAIWA Retailer (hereinafter referred to as "DAIWA Retailer"), subject to the conditions outlined below.

 

2. Please note that no statutory warranty applies to reels or rods that have previously been repaired and/or serviced by external, non-DAIWA service providers.

2.1 This warranty covers only material and manufacturing defects; no further general service life is provided.

    1. The following do not constitute material or manufacturing defects:

      • Design- and construction-related characteristics.

    2. Excluded from the warranty are also:

      • normal wear and tear (e.g. worn or noisy ball bearings, bushings, roller clutches, worn gear components, worn drag components), as well as worn rod section conjunction-systems and changes in the action curve of a rod.

      • normal signs of usage wear and age (e.g. normal fading or scratching of surfaces that do not reduce the usability, colour changes);

      • missing, lost or improperly detached assemblies (e.g. forcibly detached handle assemblies);

      • damage and corrosion damage due to improper maintenance and care of the DAIWA product, particularly damage caused by penetration of water or foreign particles (e.g. salt, sand or dust) into the inside of the reel or rod.

2.2 This warranty applies exclusively to DAIWA Products distributed by DAIWA Germany through DAIWA Retailer within European countries.

 

3. Warranty conditions

3.1 Warranty claims are only valid if all the following conditions are met:

    1. The DAIWA brand logo on the DAIWA Product must not have been altered or removed,

    2. the DAIWA Product must not have been used for rental purposes or for commercial fisheries

    3. the reported defect must not have been caused by

      • disregarding of instructions for handling and care of the DAIWA Products in the operating manual as well as inadequate or improper care and maintenance.

      • improper disassembling/ assembling, repair, modification, manipulation or any other alterations not carried out by DAIWA Germany or a technician authorized by DAIWA Germany;

      • incorrect operation, excessive or improper strain and use (e.g. fighting strong fish with an undersized fishing reel model or an undersized fishing rod);

      • continued use of a DAIWA Product that is recognizably requiring repair;

      • type of use leading to excessive wear (e.g. wear of spinning reel gear components due to disproportionate use as twitching/jerking of heavy weights and big lures);

      • action demonstration or testing by the buyer, without following proper handling guidelines;

      • use of the DAIWA Product with defective or non-genuine spare parts (optional parts), non-compatible products or accessories; or

      • severe traumatic incidents (e.g. intense shocks, strong vibrations, forcible blows).


    3.2 For electric fishing reels, the warranty does not cover defects caused by incorrect power supply, a defective or modified electric power cord.

4. Start date of warranty, warranty duration

The warranty period is 24 (twenty-four) months, beginning with the date of the conclusion of the purchase contract between the buyer and the DAIWA Retailer.

 

5. Filing and processing warranty claims

To file a warranty claim,

5.1 please send the DAIWA Product along with the original dated invoice or receipt to a DAIWA Retailer, preferably (but not necessarily) the DAIWA Retailer from whom the item was purchased. The buyer must cover any shipping costs to the DAIWA Retailer.

5.2 the DAIWA Retailer forwards the DAIWA Product handed over/sent to him by the buyer to DAIWA Germany. If the warranty claim is valid, DAIWA Germany will inspect the item for material or manufacturing defects and provide the applicable warranty service.

5.3 the buyer is not entitled to transfer warranty claims in accordance with clause 3 to a subsequent purchaser in the case of resale of the fishing reel. This restriction does not apply if the claim is for a monetary refund.

5.4 The German version of the DAIWA warranty policy set forth herein shall be the legally binding version. However, the statutory provisions of the country in which the DAIWA product was purchased shall prevail where applicable.
